1 Confirmation and Effectiveness of Service Terms​

This term applies to the product "CanGoal" of Shenzhen Zaozao Island Technology CO., Ltd. In the application market and the terms and conditions, it will be referred to as "Zaozao Island Company", "we" or "CanGoal". Since the software and services are licensed to you for use, we will also be referred to as "the licensor" in the following text.

The CanGoal App refers to the mobile terminal software and services legally owned and operated by Shenzhen Zaozao Island Technology CO., Ltd and/or its affiliated companies. The ownership and operation rights of CanGoal belong to us.

1.1 Effectiveness of Terms​

By using CanGoal and its services, it indicates that you have fully read, understood and accepted all the contents of this agreement and reached an agreement with us to become a CanGoal user. If you do not agree with any content of this agreement or cannot accurately understand the interpretation of the terms of this agreement, please do not use or perform any operation. Otherwise, the use or any operation behavior shall be regarded as accepting the constraints of this agreement. This agreement is inseparable. The use of CanGoal and its services indicates your agreement to all the contents of the agreement. Otherwise, please do not use or perform any operation.

2 Software and Service Usage Rights​

2.1 For Personal Use Only​

CanGoal is only for users' personal non-commercial use. If you want to sell CanGoal or any materials, services or any redemption codes related to or derived from CanGoal, you must obtain the permission of Zaozao Island Company.

2.2 Software License​

The applications and in-app purchases provided through software stores, web pages are licensed to you, not sold to you. You accept and understand that although you can "purchase" in-app purchases in these applications, the actual ownership still belongs to the product developer, and you only obtain limited usage rights. If you violate these terms, your usage authorization may be cancelled and you may face corresponding legal responsibilities.

2.3 Platform-specific License Restrictions​

Our service license is strictly limited to the specific platform on which it was originally distributed. Taking the iOS platform as an example, the license obtained by purchasing on this platform is limited to the use on the iOS platform and is not authorized to exercise this license on any other platform. Any license and rights granted on one platform cannot be used across platforms, and it cannot be inferred that other platforms will provide the same products or have the same service conditions.

2.4 Exception to Platform-specific License Restrictions​

Regarding the exception to the platform-specific license restrictions in 2.3, it is hereby explained:

  • The in-app purchase item "CanGoal - CanGoal Pro Membership" of CanGoal is universal on iOS, iPadOS, watchOS and macOS. That is, if you purchase the CanGoal Pro Membership on any of the above system platforms, it is universal on other Apple system platforms. There is no need to purchase again or make additional payments. The purchase mechanism provided by Apple will handle it automatically.

3 Intellectual Property Rights​

The intellectual property rights of the CanGoal software and services belong to us. Users acknowledge that CanGoal Company has all rights to CanGoal, including but not limited to all intellectual property rights. "Intellectual property rights" refer to all rights stipulated in patent law, copyright law, trade secret law, trademark law, anti-unfair competition law, etc., and all applications, updates, extensions and restorations therein, whether implemented and effective worldwide now or in the future. Users agree not to modify, adapt, translate CanGoal, create derivative works of CanGoal, obtain source code from CanGoal through decompilation, reverse engineering, disassembly or other means. Users agree not to delete, cover or change the copyright notice, trademark or other ownership notice of CanGoal Company or any third party.

4 How We Handle Your Data​

4.1 Your Data Saved in Your Mobile Phone Space or iCloud Drive​

  • Any in-app data of yours will be saved in your device and we, as developers, have no access.

  • If you have enabled the iCloud synchronization function, your data will be stored in the iCloud cloud service provided by Apple, occupying your iCloud space. As developers, we also have no access.

  • CanGoal will not ask you to provide any personal information, including but not limited to name, gender, email, mobile phone number, address.

  • CanGoal server will not store your in-app data, including but not limited to created goals, tasks, timing, habits, etc.

  • You have 100% control over your data, and at the same time you need to be responsible for your own data. Once your device has problems such as malfunctions, developers cannot help you restore data and other operations.

Important reminder, in order to protect your privacy, the data generated in the CanGoal APP is forcibly bound to your Apple ID / iTunes ID. If you switch your Apple ID and do not enable iCloud synchronization, your in-app data may be automatically deleted by Apple's security policy. Please operate with caution (but this will not affect your purchases and subscriptions)

4.2 Anonymous Browsing Information Processing​

Our server will process your anonymous browsing information. These processing operations are aimed at optimizing our services, enhancing the user experience and conducting necessary data analysis. For more detailed content on anonymous browsing information processing, you can refer to our specially formulated "CanGoal Privacy Agreement".

4.3 In-app Data Protection​

Our server will not access your in-app data, including but not limited to mood records, meditation records, HRV historical data, etc. Your such data is securely stored in your iCloud drive space. We have taken strict technical and management measures to ensure that the server cannot obtain these sensitive and personalized data. At the same time, the server will not actively and cannot perform any form of access, reading, modification or deletion operations on the data stored in the iCloud drive space (emphasis: this refers to the server, not the client program). Your control and privacy rights over these data are always fully respected and guaranteed. But at the same time, we will not provide additional protection for the data in the iCloud drive space. We believe and entrust that your data is protected and properly stored by you and Apple.

5 Software and Service Usage Matters​

5.1 Content Behavior Specifications​

Users shall be responsible for their behaviors when using this software and related services. Your use of the CanGoal software and related services must not have behaviors that violate the law and public order and good customs, including but not limited to the following behaviors:

  • Opposing the basic principles determined by the Constitution;

  • Endangering national security, divulging state secrets, subverting state power, undermining national unity, and damaging national honor and interests;

  • Distorting, uglifying, desecrating, or denying the deeds and spirits of heroes and martyrs, and infringing upon the names, portraits, reputations and honors of heroes and martyrs by insult, defamation or other means;

  • Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

  • Propagating terrorism, extremism or inciting the implementation of terrorist activities and extremist activities;

  • Damaging the national religious policy, promoting cults and feudal superstitions;

  • Spreading rumors, disturbing social order, and undermining social stability;

  • Spreading obscene, pornographic, gambling, violent, murderous, terrorist or abetting criminal content;

  • Intimidating, insulting, attacking, defaming others, and infringing upon the legitimate rights and interests of others;

  • Presenting bloody, thrilling, cruel and other discomfort-causing content;

  • Content with sexual implications, sexual teasing and other easily sexually suggestive content;

  • Improper commentary on natural disasters, major accidents and other disasters;

  • Using this platform to engage in money laundering, stealing trade secrets, stealing personal information and other illegal and criminal activities;

  • Publishing anything that infringes upon the copyrights, trademarks and other intellectual property rights and other legal rights of others;

  • Infringing upon the legitimate rights and interests of minors or damaging the physical and mental health of minors;

  • Content that may induce minors to imitate unsafe behaviors and violate social morality, induce minors' bad hobbies, etc.;

  • Spreading commercial advertisements, or similar commercial solicitation information, excessive marketing information and spam information;

  • Other content that has a negative impact on the online ecology.

  • Other content prohibited by laws and administrative regulations.

  • Other information that contains other contents that violate laws and regulations, policies and public order and good customs, interfere with the normal operation of CanGoal or infringe upon the legitimate rights and interests of other you or third parties.

6 In-app Purchases​

6.1 CanGoal Pro Membership Service​

The activation of the CanGoal Pro Membership service means that you can unlock advanced functions in the CanGoal APP and a fee will be charged to you. The prerequisite for this collection is that you have logged in and actively purchased the corresponding virtual items through the App Store. For the selected payment channel, you are obligated to ensure that the payment funds are your legally owned funds. Once Apple feeds back the abnormality of your payment account to us, we may suspend or terminate your membership service.

6.2 Price Adjustment​

We will adjust our prices up or down according to our operational needs.

  • The price adjustment will not affect previous purchases, and we will not require you to make up the difference or refund.

6.3 Purchase Instructions​

  • You can choose to subscribe to the annual plan or the one-time purchase plan according to your actual usage situation.

  • Payments will be charged to your iTunes account or Apple ID account upon confirmation of purchase.

  • Unless automatic renewal is turned off at least 24 hours before the end of the current subscription period, the subscription will be renewed automatically.

  • Your account will be charged for the renewal fee 24 hours before the end of the current period, and the renewal fee will be determined.

  • Users can manage subscriptions and also turn off automatic renewal in the "Account Settings" after purchase.

  • If any part of the free trial period provided is not used and if the user purchases the subscription for this part during the trial, the unused part will expire.

  • If you do not purchase an automatic renewal subscription, you can still use our application normally.

  • After the subscription of our application expires, any unlocked content can be used normally.

  • Minors, please purchase under the clear consent and authorization of parents after obtaining it.

  • Virtual products are non-refundable.

7 Software Usage Specifications​

It is prohibited to use any plug-ins, add-ons, systems, programs or third-party tools that are not authorized or permitted by us to interfere with, disrupt, modify or impose other influences on the normal operation of this service, including but not limited to collecting information from this service or interacting with this service by using automated scripts, etc., occupying a large amount of this service system or network bandwidth resources, and bringing a heavy load to the network, server, product or application of this service system or other users using this service, affecting the smoothness of the system.

It is prohibited to engage in any behavior that endangers the computer network security by using or targeting this service, including but not limited to:

  • Illegal intrusion into the network, interference with the normal functions of the network, theft of network data and other activities that endanger network security;

  • Provide programs and tools specifically used to engage in activities that invade the network, interfere with the normal functions and protection measures of the network, and steal network data that endanger network security;

  • Knowing that others are engaged in activities that endanger network security and providing technical support, advertising promotion and other assistance for them;

  • Use of unauthorized data or access to unauthorized servers/accounts;

  • Entering the computer network or other people's computer systems without permission and deleting, modifying, adding and storing information;

  • Attempting to investigate, scan, test the weaknesses of this service system or network or other behaviors that implement the destruction of network security without permission;

  • Attempting to interfere with or destroy the normal operation of this service system or software, deliberately spreading malicious programs or viruses and other behaviors that destroy and interfere with normal network information services;

  • Forging TCP/IP packet names or data;

  • Copying, imitating, modifying, translating, adapting, lending, selling, sub-licensing, disseminating or transferring related services on the information network, or reverse engineering, reverse assembling, compiling or otherwise attempting to discover the source code of this service;

  • Malicious registration of CanGoal accounts, including but not limited to frequent and batch registration of accounts;

  • Other behaviors that violate laws, regulations, agreements, our relevant rules and infringe upon the legitimate rights and interests of others.

8 User Privacy System​

Zaozao Island Technology CO., Ltd respects the privacy and data security of every user. We will only obtain necessary personal information in accordance with laws and regulations when registering an account and keep it properly. Therefore, except for the following circumstances, Zaozao Island Technology CO., Ltd will not disclose, edit or reveal the registration information of users or the non-public content saved in the services of CanGoal Company.

  • Comply with relevant laws and regulations, including providing the information content and its publication time released by users through CanGoal when inquired by relevant state authorities.

  • Situations related to national security and national defense security.

  • Situations related to our fulfillment of the obligations stipulated by laws and regulations.

  • Comply with the service procedures of CanGoal.

  • Maintain and protect the trademarks and other intellectual property rights of CanGoal Company.

  • Do our best to maintain the privacy and security of users in an emergency.

  • Other circumstances that Zaozao Island Technology CO., Ltd deems necessary and in compliance with laws and regulations.

This policy explains how CanGoal processes your personal information when you use the related services of CanGoal and how to protect your privacy rights. You agree to apply your data on the premise of complying with the privacy policy of CanGoal.

Agree to Use Data: You agree that those who allow you to use can collect and use technical data and related information, including but not limited to technical information about your device, system and application software and peripherals. Such information is collected regularly to facilitate the provision of software updates, product support and other services related to the licensed application to you. Those who allow you to use can use this information as long as the form of the information does not personally identify you to improve their products or provide services or technologies to you.

9 Service Changes​

The developers of CanGoal reserve the right to change, suspend or terminate the service at any time and for any reason without notifying the user. Users accept the right of CanGoal Company to exercise the change, suspension or termination of the service, and CanGoal Company is not responsible to the user or third parties.

10 Limitation of Liability​

You expressly acknowledge and agree that the use of the licensed application is entirely at your own risk.

11 Computer Software and Data Liability​

Users understand and agree to download and use CanGoal and all third-party software provided together with CanGoal or through CanGoal at their own risk, and shall be fully responsible for any damage to the computer system or loss of data caused by downloading or using CanGoal and such third-party software.

To the fullest extent permitted by applicable law, CanGoal Company expressly disclaims any other types of warranties, whether express, implied or statutory; including but not limited to any implied warranties and liabilities of merchantability, fitness for a particular purpose, reliability, accuracy, completeness, freedom from viruses and error-free.

11.1 Liability for Personal Injury and Damage​

To the extent not prohibited by law, as a virtual tool, CanGoal and the licensor shall not be liable for personal injury or any incidental, special, indirect or consequential damages under any circumstances.

To the fullest extent permitted by applicable law, CanGoal Company shall not be liable for any accidental, indirect, special or indirect damages or claims (including but not limited to damages for personal injury, privacy leakage, failure to fulfill any responsibility including good faith or reasonable care, negligence and any other monetary or other losses) arising from or in any way related to the user's use of CanGoal or its products and services.

11.2 Warranty Liability​

To the fullest extent permitted by applicable law and not prohibited by law, Zaozao Island Technology CO., Ltd and its licensors will not make the following statements or warranties to you:

  • Your use of the software or service will meet your needs;

  • Your use of the software or service will be continuous, uninterrupted, timely, secure or error-free;

  • Any information obtained by you using the relevant software or service is accurate and reliable;

  • The operational or functional flaws of any software provided to you as part of the relevant software or service will be corrected.

You expressly acknowledge and agree that the use of the licensed application is entirely at your own risk. To the fullest extent permitted by law, the licensed application and any services provided or performed by the licensed application are provided "as is" and "as available", with all errors and without any form of warranty. The licensor hereby denies all warranties and conditions provided for the licensed application and any services, whether express, implied or statutory, including but not limited to the implied warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement of third-party rights. Any oral or written information or advice given by the licensor or its authorized representatives will not create a warranty.

The act of uploading by the user means that the user or the copyright owner represented by the user authorizes CanGoal Company and its affiliates to save the content on the server of CanGoal, but the user or the original copyright owner still retains the copyright of the uploaded work, and CanGoal Company is not allowed to publish the uploaded work on other public channels without the permission of the user or the original copyright owner. If the user is involved in other services provided by Zaozao Island Technology CO., Ltd or its affiliates when using CanGoal, the corresponding service terms should also be followed.

11.4 Suggestions and Improvements​

If the user has any opinions on CanGoal or suggestions on how to improve it, they can be presented to us. Please note that if you do so, you will also grant CanGoal and third parties the right to use and incorporate your suggestions or opinions or related copyrights in CanGoal (or third-party software) for free.

Users agree to safeguard and maintain the interests of CanGoal Company and be responsible for paying the legal fees, damages compensation fees, penalties imposed by government authorities and other infringement compensation fees, etc., arising from the user's violation of this service terms or other service terms of Zaozao Island Technology CO., Ltd.

The above terms shall be governed by and construed in accordance with the laws of the People's Republic of China. In the event of a dispute, both the user and Zaozao Island Technology CO., Ltd unanimously agree to submit the dispute to the people's court where Zaozao Island Technology CO., Ltd is located for jurisdiction.
